Terms and Conditions

Please read these Terms and Conditions carefully as they will apply to all books purchased by you from Mindmatters.

Description of Goods and Services

Mindmatters Educational Bookstore (Mindmatters) is a book and study material supply business in the retail and education industry. We supply books to private individuals, companies and various learning institutions. We provide related booklist services to contractual customers in order to meet their book requirements.

Sale and Purchase

Products can be purchased in-store or ordered electronically via our Website.
We do not keep stock of all titles, so orders are subject to availability.
Should we not have stock at time of receipt of your order, or the materials ordered are Print-On-Demand titles, you will be notified of estimated time of delivery by email.
All products purchased by whatever means shall be subject to these Terms and Conditions as well as the provisions contained in our Quotation or Tax Invoice (together referred to as the Agreement).
Where there is a conflict between the provisions of these Terms and Conditions and Quotation or the Tax Invoice, the provisions of the Quotation or Tax Invoice, as the case may be, will apply.

Delivery 

You will receive by email a detailed tax invoice showing the price of the books, the delivery fees, Value-Added Tax and the amount owing by to you to us which is to be paid prior to delivery. No deliveries will be despatched until payment in full has been received.
Books will be delivered as soon as reasonably possible after receipt of payment by us to the address chosen by you for delivery. You understand and agree that all orders are however subject to availability and we are not able to guarantee exact delivery dates.
Please note that some areas may take longer for delivery. Please confirm this by looking at the Delivery Schedule on our website.
Delivery will be confirmed in writing by way of delivery tracking number and invoice via email.

Mindmatters uses an outsourced courier company which delivers Monday to Friday during working hours only. No special arrangements can be made for delivery out of these hours. The couriers are not able to make contact with you from their personal mobile phones if you are not available at time of delivery, and your order will be returned to Mindmatters.
It is your responsibility to ensure that the delivery address given by you to us is correct and Mindmatters cannot be held responsible for any incorrect information given or non-delivery as a result thereof. If the address is incorrect or the goods cannot be delivered for any reason whatsoever that is within your control, the goods will be returned to Mindmatters. You’ll be contacted to make alternative delivery/collection arrangements. As we use an outsourced courier company there will be an additional fee for the re-delivery. We will only arrange the re-delivery once payment reflects in our bank account.

You are responsible to examine the Products ordered upon delivery to ensure that there are no visible signs of damage or missing products. In the event that there are missing, damaged or incorrect goods, please contact us within 48 hours of your delivery.
You or your authorised representative will be asked to sign a duplicate copy of the required delivery documentation to confirm receipt of the books.
We have outsourced all delivery and collection arrangements to third party service providers. Accordingly, we cannot, to the extent permitted by law, be liable for any loss or damage caused by them.
Delivery costs, if any are set out in the Delivery Schedule on our website.

Return and Refunds Policy

The provision of goods and services by Mindmatters is subject to availability. In cases of unavailability once orders have been placed, Mindmatters will offer customers the option of a full refund within 30 days from the date on which the order is acknowledged by us.
Cancellation of orders is to be in writing by email or fax and is acceptable before delivery only. Imported titles, Print-On-Demand or Firm orders titles e.g. Nated publications or BPP & Kaplan material cannot be cancelled as these are ordered especially for customers. Please check with our customer services department if you want to clarify if the titles you require are imported, Print-On-Demand or Firm Sale titles before placing and paying for for your order.
Once delivery has been made, a book may be returned within 7 (seven) days of receipt thereof provided that:

  • The books ordered are not Imported, Print-On-Demand or Firm Sale titles.
  • Returned books must be in original condition and where appropriate in original packaging
  • Customers are required to present their original tax invoice or till slip
  • No refunds will be given upon return of any book, but you will be eligible for a credit voucher.

Where any books are damaged, defective or incorrectly supplied at the time of delivery to you, we will replace the product with another copy of the same product. You must notify us within 7 (seven) days of delivery of any such defect, damage or incorrectly supplied product.

If another copy of the same product is not available, we will refund the full amount of the purchase, provided that you have not misused or damaged the book. This includes labelling, covering or making any markings in the book. You will need to give us proof of purchase in order to obtain a refund or book exchange.
We shall have no liability or obligation to you with respect to any books which have been subjected to abuse, misuse, improper use, negligence, accident, alteration, tampering or faulty repair, or as a result of ordinary wear and tear by you and you hereby indemnify us accordingly.

Customer Privacy Policy

You understand and agree that we (“Mindmatters”) are in possession of information that identifies you (“Personal Information”) and that we may use the Personal Information to:

  • open, administer and service this Agreement;
  • to develop and improve our products;
  • update our records;
  • to identify which of our products, or others’ products might interest you.

We will keep your Personal Information confidential and only give it to others for the above purposes, including:

  • to our agents and subcontractors, acting for us, to use for the purpose of operating our business and obtaining payment in terms of this Agreement;
  • to share information via organisation/s which provides a centralised application matching service which it collects from and about applications, for the purpose of preventing and detecting fraud;
  • to financial institutions or payment distribution agencies for purposes of payment processing;
  • unless You opt out by emailing us or in the opt out box in the Application, to third parties who may use it to contact You by email, telephone, mail, SMS or other method permitted by law in relation to offers they feel might interest You.

Your Personal Information may also be used for other purposes for which you give your permission or when required by any relevant law.
Your Personal Information is held subject to Our Privacy Policy and the applicable Law.
By purchasing the books from us and concluding this agreement, you agree to our privacy policy.

Payment Options Accepted

Payment made to us via the following methods:
Credit card payments on our website. We accept Visa, Master Card and Diners cards.
EFT or bank transfer or branch deposit into the Mindmatters Educational Bookstore bank account, the details of which can be found on the Tax Invoice.
Please note that orders will not be processed until proof of payment has been received by Mindmatters and funds reflect in our bank account. (Please note that payments made from banks other than Standard Bank may take up to 3 (three) working days to reflect in our account)
Take note that cheque deposits and cash deposits might attract bank charges. The customer will be liable for any bank charges in-excess-of R25.00. Please check with your bank before making a cheque or cash deposit.

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is ZAR (South African Rand).

Credit Card Acquiring and Security

Credit card transactions will be acquired for Mindmatters by Virtual Card Service (Pty) Ltd who are the approved payment gateway for Standard Bank of South Africa. Comalytics uses SSL3 and credit card information is stored per Visa and MasterCard guidelines on the website. Customers may go to www.comalytics.com  (Comalytics) to view their security certificate and security policy.

Customer Details Separate from Card Details

Customer details will be stored by Mindmatters separately from card details which are entered by the customer on Comalytics secure site. For more detail on Comalytics refer to www.comalytics.com

Governing Law and Contact Details

his agreement and the Terms and Conditions are governed by the laws of South Africa.
Mindmatters chooses as its contact address for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 23 Cecile Road, Norwood, Johannesburg, 2192, South Africa
The Customer chooses as its contact address for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, the address stated as the address for delivery of products ordered.

Variation

We have in the drafting of these Terms and Conditions used our best endeavours to comply with all applicable laws.
To the extent that this Agreement may require amendment in order to comply with any particular law, you by your signature hereto agree to such amendment which will be made available to you and effective from the date it is changed.
